What is notification?

Notification of a foreigner's stay in the Republic of Kazakhstan is a mandatory procedure provided for by the migration legislation of the Republic of Kazakhstan.

The host party is obliged to notify the migration services about the stay of all foreign citizens, regardless of their age, nationality, citizenship, purpose of entry and other factors, according to Government Resolution No. 148 of January 21, 2012.

The obligation to submit a notification applies regardless of the presence of a visa or temporary residence permit (TRP), since this procedure does not replace them.

The foreign citizens themselves do not need to contact the migration service.*

Who is required to submit?

The responsibility for filing the notification lies with the host party. The host party may be:

  1. Employers who have invited a foreign specialist to work.
  2. Partner companies who have invited a foreign specialist on a business trip or business trip.
  3. Hotels and hostels that accommodate foreigners.
  4. Individuals: apartment owners who provide housing to foreigners for rent, relatives, friends.

In what cases is it filed?

  1. Upon each arrival of a foreign citizen to Kazakhstan from abroad;
  2. When changing the address of residence of a foreign citizen.
The notification is submitted within three working days. The period starts from the date of arrival in the RK, change of place of residence in the RK and departure on a business trip, personal trip within the RK.

For example:
  • upon arrival in the RK on Sunday, the deadline for submitting the notification is Wednesday, i.e. the 3rd working day.
  • upon arrival in the RK on Monday, the deadline for submitting the notification is Wednesday, i.e. also the 3rd working day.

How to submit a notification?

Today, notifications are submitted online, without submitting them in paper form.

Two platforms are available:
  • Visa and migration portal vmp.gov.kz
  • E-Qonaq.kz

To work in both portals, you will need the digital signature keys of the receiving party.

To receive the service online in VMP, you need to:

  1. Log in to the portal vmp.gov.kz;
  2. Select the public service "Notification of stay of a foreigner"
  3. Fill in the information about the foreigner, and if necessary, about his children.
  4. Sign the completed application form using an electronic digital signature;
  5. Download the notification in your personal account.

To receive the service online in e-Qonaq.kz, you need to:

  1. Log in to the system or mobile application
  2. Scan the foreigner's document or enter the data manually
  3. Submit a notification
  4. Download the notification in your personal account.

Liability

According to Article 518 of the Code of Administrative Offenses of the Republic of Kazakhstan, the following liability is provided.

For the first offense:
  • for individuals - a warning
  • for officials, small business entities or non-profit organizations - a fine of 10 MCI,
  • for medium-sized businesses - a fine of 15 MCI,
  • for large businesses - a fine of 20 MCI.

For a repeated offense within a year after the imposition of an administrative penalty:
  • for individuals - 30 MCI
  • for officials, small business entities or non-profit organizations - a fine of 40 MCI,
  • for medium-sized businesses - a fine of 70 MCI,
  • for large businesses - a fine of 100 MCI.

Also, in accordance with Article 48 of the Law "On Migration of the Population of the Republic of Kazakhstan", applications from host persons to invite foreigners to the Republic of Kazakhstan will not be considered if, within 12 consecutive calendar months prior to the submission of such an application, the host persons were held liable two or more times for failure to promptly inform the internal affairs agencies about immigrants staying with them.

It is important to note that failure to submit a notification on time or not at all may affect the possibility of obtaining a temporary residence permit or visa in the future as part of the foreigner’s trip.
