From January 1, 2024, foreigners who have reached the age of 16 are required to undergo a dactyloscopy (fingerprinting) procedure when applying for a temporary residence permit (TRP). This means that fingerprints must be submitted before receiving a TRP.

Who does not need a TRP?

  • Persons arriving with a visa to the Republic of Kazakhstan
  • Persons under 16 years of age
  • Persons holding diplomatic and service passports

When is it necessary to apply for a TRP?

* REMINDER:

  • Citizens of the EAEU member states - up to 90 days from the date of entry, in total no more than 90 days within 180-days period
  • Citizens of Uzbekistan - up to 3/trp0 days from the date of entry
  • Citizens of Tajikistan, Azerbaijan - up to 90 days from the date of entry

NOTIFICATION OF ARRIVAL
Regardless of citizenship and purpose of stay, the host party is obliged to submit a notification of the foreigner's stay within 3 working days from the date of entry.

According to the purpose of entry (work, family reunification, study, etc.), a TRP is required if the duration of the foreigner's stay in Kazakhstan exceeds the permitted limit*.

An application for a TRP is submitted to the Public Service Center at the place of registration of the service recipient (legal entity or individual).

Validity period of the TRP

When concluding an employment contract (EC) or a civil contract for services with a Kazakhstani employer, a foreign national can obtain a TRP for up to 1 year, but not longer than the validity period of the documents that serve as the basis for the permit (such as the employment or service contract, medical insurance, or the consent of the landlord for temporary registration). The exact validity period of the TRP is determined by the migration authorities based on the documents submitted.

If the EC was signed long before the TRP application, in practice the permit is usually issued for the remaining term of the contract, but within the limit of 1 year.

A TRP for accompanying family members (spouse and children) is issued for the same period and on the same grounds as the TRP of the main applicant
Imputed health insurance

According to Article 26 of the Labor Code of the Republic of Kazakhstan, in order to conclude an Employment Agreement with a non-resident, a foreigner must have a contract of imputed medical insurance covering primary health care and specialized medical care in hospital conditions in an emergency form under the conditions established by the laws of the Republic of Kazakhstan

Registered Employment Contract
An employment contract concluded in paper form must be registered in the Unified System for Registration of Employment Contracts (ESUTD).

Dactyloscopy

Liability
For foreigners:
Failure to issue a temporary residence permit in a timely manner and/or violation of the terms of stay and failure to leave the Republic of Kazakhstan within the established time limits shall entail:
1) within three days – a warning;
2) more than three days before the expiration of five days – a fine of 10 MCI;
3) more than five days before the expiration of ten days – a fine of 15 MCI.
4) more than ten days – shall entail a fine of 25 MCI or administrative expulsion from the country.

Foreigners or stateless persons previously expelled from the Republic of Kazakhstan are prohibited from entering the Republic of Kazakhstan for five years from the date of execution of the court decision on expulsion.

Failure by the host to take measures for the timely registration of foreigners or the execution of documents for their right to stay in the Republic of Kazakhstan, or their departure from the Republic of Kazakhstan upon expiration of a certain period of stay, or untimely informing the internal affairs agencies about immigrants staying with them shall entail:
1) for individuals - a warning;
2) for officials, small business entities or non-profit organizations - a fine of 10 MCI;
3) for medium-sized businesses - a fine of 15 MCI,
4) for large businesses - a fine of 20 MCI.
